Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Isaiah 41 LLC, d/b/a Anchor Co ("Anchor Co AI," "we," "us," or "our"), a Missouri limited liability company. By creating an account or using our services at anchorcoai.com (the "Service") you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You must be at least 16 years old to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or legal guardian.

Anchor Co AI is an AI chatbot builder. We crawl the URLs you provide, train a chatbot on that content and on any knowledge notes you add, and host an embeddable widget for your website. The Service relies on third-party AI providers (currently Anthropic and OpenAI) to generate responses.

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs on your account. Notify us immediately at security@anchorcoai.com if you suspect unauthorized access.

You agree not to:

• Train chatbots on content you do not own or have the right to use
• Use the Service to generate spam, misinformation, harassment, defamation, or illegal content
• Use the Service to produce content that infringes intellectual property, privacy, or publicity rights
• Attempt to reverse-engineer, attack, probe, scan, or circumvent rate limits, authentication, or security controls of the Service
• Use the Service to build a competing product or benchmark it without our prior written consent
• Resell the Service without a valid Agency plan and written permission
• Use the Service in connection with any application involving medical, legal, financial, or other decisions requiring professional judgment, without independent expert review
• Violate any applicable law, including export-control and sanctions laws

Violations may result in suspension or termination of your account without refund, in addition to any other remedies available to us.

You retain ownership of all content you upload, paste, or direct the Service to ingest ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display Your Content solely to provide and improve the Service for you. We will not sell Your Content, and we will not use it to train general-purpose AI models.

You are solely responsible for Your Content, including ensuring you have the rights necessary to use it with the Service and that it complies with applicable law.

Paid plans are billed monthly or annually in advance via Stripe. You can cancel any time from your billing portal — cancellation takes effect at the end of the current billing period. We do not offer refunds for partial periods, but if something went wrong, email billing@anchorcoai.com and we will do our best to make it right.

Prices are in U.S. dollars and exclude applicable taxes, which you are responsible for paying. We may change prices with at least 30 days' notice to account holders; changes take effect at your next renewal.

If you exceed your plan's message or page limits, we will email you and temporarily pause chatbot responses until you upgrade or the next billing period begins.

A 7-day free trial applies to paid plans for first-time customers. No charge during the trial. You can cancel any time before the trial ends.

Chatbot responses are generated by third-party AI models and may be inaccurate, incomplete, biased, or offensive. AI responses are not legal, medical, financial, or professional advice. You are solely responsible for reviewing AI output and for any decisions you or your visitors make based on it. We disclaim all liability for reliance on AI output.

The Service integrates with third parties (Stripe, Shopify, WordPress, and others). Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services.

The Service, including the Anchor Co AI name, logos, code, and documentation, is owned by us and protected by U.S. and international intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service during the term of your subscription.

If you believe content on the Service infringes your copyright, send a DMCA notice to security@anchorcoai.com including all information required by 17 U.S.C. § 512(c)(3).

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR PRODUCE FACTUALLY CORRECT OUTPUT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS.

Some jurisdictions do not allow certain limitations of liability; in those jurisdictions our liability is limited to the extent permitted by law.

You will defend, indemnify, and hold us harmless from any third-party claim, damages, or costs (including reasonable attorneys' fees) arising out of (a) Your Content, (b) your use of the Service in violation of these Terms or applicable law, or (c) your willful misconduct.

You can cancel any time from your billing portal. We may suspend or terminate your account at any time for material breach of these Terms, non-payment, or legal necessity. Upon termination, your right to use the Service ends. Sections that by their nature should survive termination (including Sections 5, 7, 10, 11, 12, and 14) will survive.

These Terms are governed by the laws of the State of Missouri, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Missouri, and you consent to the personal jurisdiction of those courts.

If you are a consumer in the European Union, United Kingdom, or another jurisdiction where local law grants you the protection of mandatory consumer rules, nothing in this section deprives you of those protections.

We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, internet or telecommunications failures, government action, or failures of third-party infrastructure.

We may update these Terms. Material changes will be emailed to account holders at least 14 days before taking effect. Continued use of the Service after the effective date means you accept the updated Terms.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them freely. These Terms do not create a partnership, agency, or joint venture.
